Contra a imunidade, Fisco sugere a incidência de PIS e COFINS sobre receita de exportação após liquidação do contrato.
Em 26/03/2018, a Receita Federal do Brasil divulgou a Instrução Normativa RFB nº 1801, que veio disciplinar “as operações de câmbio e a manutenção de recursos no exterior, em moeda estrangeira, relativos a exportações de mercadorias e serviços, e institui obrigação de prestar informações à Secretaria da Receita Federal do Brasil (RFB)”.
Trouxe uma série de obrigações relativas à manutenção de recursos no exterior e definições para fins de aplicação da legislação correspondente. Chama a atenção, no entanto, o art. 3º, § 2º, da referida IN que revela, a princípio, a intenção da Administração de tributar receitas decorrentes de exportação. Transcreve-se o dispositivo:
Art. 3º Sobre as receitas mantidas no exterior na forma prevista no art. 1º, decorrentes da prestação de serviços para pessoa física ou jurídica residente ou domiciliada no exterior, não incidem a Contribuição para o PIS/Pasep e a Contribuição para o Financiamento da Seguridade Social (Cofins).
Traduzindo o comando em questão, estaria ao abrigo da incidência da contribuição ao PIS e da COFINS apenas a variação cambial de receita de exportação ocorrida até o momento do pagamento da contraprestação pelo produto ou pelo serviço exportado, a partir de quando, infere-se, passaria a ser normalmente tributada.
Essa percepção é reforçada quando se analisa o disposto no Decreto nº 8.246/2015, objeto de regulamentação pela IN nº 1801, que “Restabelece as alíquotas da Contribuição para o PIS/PASEP e da COFINS incidentes sobre receitas financeiras auferidas pelas pessoas jurídicas sujeitas ao regime de apuração não-cumulativa das referidas contribuições”. Estipulou-se, em seu art. 1º, § 3º, que as receitas financeiras decorrentes de variações monetárias incidentes sobre o resultado de operações de exportação de bens e serviços para o exterior estariam sujeitas à alíquota zero das referidas contribuições.
Como se pode notar, a referida norma pressupõe que as receitas financeiras decorrentes de variações monetárias seriam tributáveis ao sugerir que estariam elas “apenas” beneficiadas pela aplicação de alíquota zero, bastando o seu aumento para que surgisse a obrigação tributária corrrespondente.
Este entendimento, todavia, contrasta com a imunidade tributária instituída sobre as receitas decorrentes de exportação prevista no art. 149, § 2º, I, da Constituição.
Conceitualmente, a imunidade é o instrumento pelo qual o constituinte retira a competência do ente tributante sobre determinado raio de incidência tributária, ou seja, afasta do poder de tributar uma dada situação jurídica. Se não pode tributar, porque fora do seu alcance, tampouco poderia conceder benefício tributário em relação à respectiva situação. Aproveita-se a conceituação dada por Paulo de Barros Carvalho.
“Classe finita e imediatamente determinável de normas jurídicas, contidas no texto da Constituição da República, e que estabelecem, de modo expresso, a incompetência das pessoas políticas de direito constitucional interno para expedir regras instituidoras de tributos que alcancem situações específicas e suficientemente caracterizadas”.
A partir desse ensinamento, nota-se a primeira inconsistência, do art. 3º, § 2º, da IN nº 1801, que trata como benefício (concedido à liberalidade do ente tributante) o que deriva de imunidade (fora do alcance do poder tributante).
Não bastasse a imprecisão ora suscitada, acredita-se haver grave inconstitucionalidade material na sinalização de que estariam acobertados pela não tributação apenas os recursos financeiros derivados de variação cambial ocorrida até a liquidação do contrato.
A ideia do constituinte ao imunizar as receitas decorrentes de exportação foi, de um lado, tornar os produtos brasileiros competitivos no mercado externo, fortalecendo a indústria nacional e, de outro, equalizar a tributação frente à ordem tributária mundial, que adota, em regra, o critério do destino, ou seja, onerando o produto apenas onde é consumido, e não onde é produzido.
A aplicação da norma de imunidade, por sua vez, não poderia fugir ao objetivo proposto pelo constituinte, quando, ao contrário, deve ser interpretada de acordo com o seu mais longo alcance, conforme entendimento reiteradamente aplicado pelo STF.
A partir dessa premissa, não poderia a Administração Pública, na sua função executiva, restringir o escopo da imunidade deixando descoberta parte das receitas decorrentes da exportação, em que se inclui, invariavelmente, a variação cambial da contraprestação do serviço ou do produto exportado após a liquidação do contrato.
Veja que a Suprema Corte, no julgamento do RE nº 627.815/PR, em que se reconheceu repercussão geral relativa ao tema (tributação de variações cambiais decorrentes de exportação), decidiu que “Consideram-se receitas decorrentes de exportação as receitas das variações cambiais ativas, a atrair a aplicação da regra de imunidade e afastar a incidência da contribuição ao PIS e da COFINS”.
A despeito dos fundamentos suscitados no julgamento, valeu-se a IN RFB nº 1801, ao que tudo indica, isoladamente, da afirmação contida no voto condutor do referido acórdão de que “…eventual variação da taxa de câmbio entre o fechamento e a liquidação do contrato configura receita decorrente de exportação, sempre que seja favorável ao exportador”, para interpretar passível de tributação a variação da taxa de câmbio posterior após a liquidação do contrato.
Sua conclusão, entretanto, carece de legitimidade visto que pautada na negação do antecedente. Se é possível afirmar que a imunidade alcança a variação da taxa de câmbio entre o fechamento e a liquidação do contrato, não há elementos suficientes para sustentar que a imunidade não alcançaria a variação cambial após a liquidação do contrato. A menção feita no referido acórdão ao marco temporal sobre o qual, certamente, incidiria a norma imunizante (entre o fechamento e a liquidação do contrato), ao contrário do que parece supor a Receita Federal, apenas reflete os contornos fáticos da situação ali analisada, não se confundindo com interpretação restritiva ao alcance da imunidade pela Suprema Corte.
Como se depreende do próprio voto condutor do acórdão citado, não há qualquer restrição temporal ao alcance da imunidade sobre as receitas decorrentes da exportação, o que confirma a interpretação extensiva a ela emprestada:
“(…)
A imunidade alcança toda uma materialidade, no caso, a receita decorrente da exportação, independentemente do transcurso do tempo. É como se o fato gerador do tributo se revelasse por um fato não contemplado pela hipótese de incidência, correspondente ao fechamento do contrato, o que se assemelha a criação de um tributo à margem do Princípio da Legalidade.
(…)
Corrobora, por fim, o presente posicionamento, o fato de a imunidade em questão não ser concedida apenas às “receitas de exportação”, senão às “receitas decorrentes de exportação” (art. 149, § 2º, I). O adjetivo “decorrentes” confere maior amplitude à desoneração constitucional, suprimindo do alcance da competência impositiva federal todas as receitas que resultem da exportação, que nela encontrem a sua causa, representando consequências financeiras do negócio jurídico de compra e venda internacional; evidencia, por consequência, a intenção, plasmada na Carta Política, de se desonerarem as exportações por completo, a fim de que as empresas brasileiras não sejam coagidas a exportarem os tributos que, de outra forma, onerariam as operações de exportação, quer de modo direto, quer indireto”.
Não há, portanto, sinais de que tenha o constituinte limitado a imunidade das receitas decorrentes da exportação ao momento do pagamento da contraprestação pela exportação. Como bem observado no julgamento em destaque, a expressão “receitas decorrentes da exportação” possui uma amplitude maior que a simples receita auferida pela exportação ou pagamento pelo serviço ou produto exportados. Ou seja, extrai-se a finalidade de se proteger as receitas na sua acepção mais abrangente.
O que está imunizado não poderia deixar de sê-lo pela sucessão de fatos estranhos à norma de imunidade. Assim: se não há limitação expressa à imunidade das receitas decorrentes de exportação, e; se a variação cambial constitui receita decorrente de exportação, logo; a variação cambial está contemplada pela imunidade.
Por tudo isso, acredita-se ser inconstitucional a previsão inscrita na IN nº 1801/2018, que alarga a incidência da contribuição ao PIS e à COFINS para alcançar a variação cambial da receita auferida pela exportação de produto ou serviço após a liquidação do contrato, sujeita a imunidade.

I – Esta Suprema Corte, nas inúmeras oportunidades em que debatida a questão da hermenêutica constitucional aplicada ao tema das imunidades, adotou a interpretação teleológica do instituto, a emprestarlhe abrangência maior, com escopo de assegurar à norma supralegal máxima efetividade.
II – A interpretação dos conceitos utilizados pela Carta da República para outorgar competências impositivas (entre os quais se insere o conceito de “receita” constante do seu art. 195, I, “b”) não está sujeita, por óbvio, à prévia edição de lei. Tampouco está condicionada à lei a exegese dos dispositivos que estabelecem imunidades tributárias, como aqueles que fundamentaram o acórdão de origem (arts. 149, § 2º, I, e 155, § 2º, X , “a”, da CF) . Em ambos os casos, trata-se de interpretação da Lei Maior voltada a desvelar o alcance de regras tipicamente constitucionais, com absoluta independência da atuação do legislador tributário.

IV – O art. 155, § 2º, X, “a”, da CF – cuja finalidade é o incentivo às exportações, desonerando as mercadorias nacionais do seu ônus econômico, de modo a permitir que as empresas brasileiras exportem produtos, e não tributos -, imuniza as operações de exportação e assegura “a manutenção e o aproveitamento do montante do imposto cobrado nas operações e prestações anteriores”. Não incidem, pois, a COFINS e a contribuição ao PIS sobre os créditos de ICMS cedidos a terceiros, sob pena de frontal violação do preceito constitucional.
